Terms and conditions for translations

Trading under the business name Absolute Czech Translations (further only ACT), Milada Cogginsová Zajíčková is a provider of top quality linguistic services.

The following details are discussed with the clients when placing an order, and must be confirmed in writing using a Purchase Order:

  • Customer's name and contact details
  • Source and target languages
  • Purpose of the use of the translation
  • Required use of any translation memory tools
  • Standard charging rates & surcharges or the total price
  • Form of payment
  • The payment period
  • Customer's signature

Payments

I accept the following forms of payment:

  • UK bank cheques
  • Bank account transfer in GBP (BACS or CHAPS)
  • On-line payment via PayPal in GBP

It is my policy when translating short documents for private clients (not translation agencies or companies) to only commence work once I have received payment in full. For example, if you order a translation of your birth certificate.

A payment period of 30 days from the date of invoice usually applies to commercial clients.
Interest of 4% per month will be charged on top of the outstanding amount for late payments after the due date.

Confidentiality

ACT will treat all work with complete confidentiality. ACT will ensure that the need for confidentiality is made known to any third parties (checkers and proofreaders) who will be involved with the work.

Copyright

When it is agreed that copyright is to be assigned to the Client after translation, such copyright shall only be assigned when full payment for the work carried out has been received by ACT. Until such a time, the copyright shall be owned by ACT.

Copyright may subsist in material that is either in the written, spoken, recorded or electronic form (on floppy disc or CD ROM, etc.)
ACT accepts documents in good faith on the understanding that the client has full rights to the use of the text. The client shall remain liable for any damages or legal action taken by a third party for breach of copyright.

Text Errors - ACT shall not be liable for any errors resulting from illegibility of the text supplied by the client for translation.

Delay & Cancellation

1. Whilst ACT will always try to deliver the work by agreed deadlines, it cannot be held responsible for any cancellation or delay caused either by the client's actions or Force Majeure - 'Acts of God' (such as: fire, flood, or any other natural disaster, civil disturbance, industrial action or any other situation beyond our control, such as ill health).

In such an event ACT will notify the client of the circumstances, which shall entitle both the client and ACT to withdraw from the contract for the work. The client shall pay ACT for any work completed and ACT will use it's best endeavours to assist the client to place the work elsewhere or take some other remedial action.

2. If the client cancels translation work after it has been commissioned they will be obliged to pay for all completed work, up to that date, on a pro-rata basis. If the client cancels less than 24 hours before the time when the translation is due then they will be liable to pay the fee in full.

Indemnity

The client shall indemnify ACT against all claims & costs for which ACT may become liable under any claim of libel or slander or other legal proceedings arising out of work carried out for the client.

ACT shall indemnify the client for any claims & costs for which ACT may be liable due to negligence or poor quality of work. As a professional service provider ACT has an indemnity insurance policy with the Institute of Translation and Interpreting
